Role description

Appointment Type: Temporary Exempt (TEX) Appointment. This position is excluded by the Charter from the competitive civil service examination process and shall serve at the discretion of the appointing officer.

The Workforce Division is seeking an experienced, motivated, and team oriented Senior Workforce Compliance Officer to supervise the Compliance Team of the CityBuild Program and its various construction workforce policies, including the Mandatory Local Hiring Policy for Construction, First Source Hiring Program, HUD Section 3, and other workforce hiring policies and support the placements of CityBuild Academy graduates and construction jobseekers.

Position Description

Under direction of the CityBuild Director, the Workforce Compliance Manager is responsible for supervising staff in administering the City’s construction workforce policies, manage a portfolio of construction projects subject to local, state and federal workforce policies including writing field reports, document complaints, generate summary reports, develop case notes for compliance purposes, and administer liquidated damages.  Additionally, the Workforce Compliance Manager will lead Contract Compliance Officers and Compliance Specialists to support the First Source Hiring Program for the City’s professional services contracts.  Professional services contracts encourage the hiring of entry-level positions and trainees on publicly-funded contracts where professional positions are available.  The Compliance Manager will perform a variety of activities related to the oversight and administration of hiring policies and training programs offered by the Office of Economic and Workforce Development, which may include evaluation of policies and legislations, program planning and development, database management, preparation, analysis of reports and other duties as required, and directs the activities of subordinate staff and performs related duties as required. This position requires organization development experience for supervision and development of staff. Project management experiences are needed to manage a project from beginning to finish and make recommendations for budgetary purposes.

RESPONSIBILITIES

  1. Administer workforce compliance on the City’s hiring policies, including First Source hiring for professional contracts.  Supervise staff to ensure consistent delivery of compliance services and project monitoring. Work in partnership with other CityBuild staff to ensure contractors are resourced to meet relevant hiring needs.
  2. Liaise and expands partnerships with contractor associations, labor unions, government groups, educational partners, and community-based organizations to enhance training opportunities on behalf OEWD and other City Departments.
  3. Works closely with the CityBuild Operations Manager and CityBuild Academy Manager to coordinate training and liaison activities with the pre-apprenticeship training programs.
  4. Attend pre-bid and pre-construction meetings as scheduled; conduct regular site visits to monitor workforce compliance and assess project progress. Monitor progress towards workforce goals on construction projects as assigned.  Prepare and disseminate workforce reports to assist contractors and City departments with meeting workforce goals.
  5. Develop and administer training programs for CityBuild staff for consistent delivery of services to the public including workforces for interdepartmental partnership, contractors, and the general public.
  6. Develop construction labor projections and project management systems for tracking and monitoring of construction projects.
  7. Collaborates with internal and external stakeholders to lead strategic, cross-sector partnerships to advance agency mission and goals.
  8. Advise City departments, contractors, members of the public, and other stakeholders on workforce policies related to the Local Hiring Policy for Construction, First Source Hiring Program, federal workforce goals, and other workforce goals as applicable. 
  9. Analyze workforce trends and develop policies and procedures for CityBuild’s training program and workforce compliance, as needed.
  10. Provide ongoing support to CityBuild Academy, OEWD’s construction pre-apprenticeship program and Construction Administration Training Program.
  11. Analyze data to provide monthly reports to manager, contractors, project managers, and other associates for workforce compliance.
  12. As required, participate in significant program planning, database management, project implementation, program evaluation, and prepare a wide variety of reports, memoranda and correspondences related to workforce program and policy activities for OEWD.  Perform related duties as required.
  13. In consultation with the Director, administer liquidated damages based on the policies and procedures set forth by the compliance program.
  14. Supervising the activities of subordinate staff assigned to these programs. 
  15. Develop policies and procedures consistent with City regulations in the implementation of the workforce hiring policies to promote local workforce.
  16. Analyze comprehensive data to make budgetary recommendations to promote successful implementation of the various construction workforce programs.
  17. Provide staff support to the Mayor’s Construction Workforce Advisory Committee and other governing Boards of OEWD.

How to qualify

Minimum Qualifications

These minimum qualifications establish the education, training, experience, special skills and/or license(s) which are required for employment in the classification. Please note, additional qualifications (i.e., special conditions) may apply to a particular position and will be stated on the exam/job announcement.

Education:

Possession of a baccalaureate degree from an accredited college or university with major coursework in industrial relations, social sciences or a related field.

Experience:

Six (6) years of experience reviewing, monitoring, and developing contract or other compliance programs involving contracts, ordinances or vendors. Such experience must have included :

a) Providing technical direction on procurement, negotiation, and contract bidding procedures to ensure compliance with all contract requirements; OR

b) Promoting equal opportunity, affirmative action and non-discrimination objectives in contracting; OR

c) Monitoring and enforcing prevailing wage, wage and hour laws, or labor standards; OR

d) Construction contracts or construction management experience in monitoring and enforcing prevailing wage, wage and hour laws, or labor standards; OR

e) Public policy or program development related to health care coverage/ access or family work-life balance; OR

f) Reviewing, monitoring and enforcing workforce development policies.

Substitution:

Education Substitution - Additional experience as described above may substitute for the required degree on a year-for-year basis. One (1) year of experience will be considered equivalent to thirty (30) semester or forty-five (45) quarter units.

Education Substitution - Completion of a State of California approved building trades apprenticeship program may substitute for two (2) years of the required professional degree.

Experience Substitution - Possession of a Master’s degree in industrial relations, social sciences or a related field or a Juris Doctorate may substitute for one (1) year of the required experience.

Verifiable administrative/professional experience involving community development, housing and/or housing development, workforce development, finance, education, social work, children/youth work, or criminal justice may substitute for the educational requirement in Minimum Qualification #1 on a year-for-year basis.
